Diese Allgemeinen Geschäftsbedingungen regeln die Nutzung der Website koenigstadt-workspace.de sowie den Prozess der Anfrage und Wartelistenaufnahme. Die individuellen Mietbedingungen ergeben sich aus dem jeweils geschlossenen Untermietvertrag (KW-Serie).
(1) Diese AGB gelten für die Nutzung der Website und für die Nutzung des Kontakt- und Wartelistenformulars der Königstadt Workspace GmbH (nachfolgend „Königstadt" oder „wir").
(2) Königstadt bietet Büroflächen und Arbeitsplätze ausschließlich an Unternehmer im Sinne des § 14 BGB. Eine Vermietung an Verbraucher im Sinne des § 13 BGB erfolgt nicht.
(3) Entgegenstehende oder abweichende Bedingungen des Anfragenden finden keine Anwendung.
(1) Königstadt betreibt einen CoWorking Space mit privaten Büros und Einzelarbeitsplätzen an der Straßburger Str. 55, 10405 Berlin. Das Angebot umfasst die Untervermietung von Arbeitsplätzen inkl. Gemeinschaftsinfrastruktur (Küche, Konferenzräume, Telefonkabinen, Internet, Kaffee) zu den im jeweiligen Untermietvertrag festgelegten Konditionen.
(2) Die Website dient der Information und der Erfassung von Mietinteressen. Ein Vertragsabschluss erfolgt ausschließlich durch beiderseitig unterzeichneten Untermietvertrag.
(3) Die auf der Website dargestellten Verfügbarkeiten und Inhalte sind freibleibend und stellen kein bindendes Angebot dar.
(1) Mit dem Absenden des Kontaktformulars beantragen Sie die Aufnahme auf die Warteliste. Die Aufnahme begründet keinen Anspruch auf Abschluss eines Mietvertrags.
(2) Sobald ein geeigneter Platz frei wird, nimmt Königstadt auf Basis der Warteliste Kontakt auf. Die Auswahl liegt im freien Ermessen von Königstadt; insbesondere können Passung zur bestehenden Community und wirtschaftliche Kriterien berücksichtigt werden.
(3) Die Aufnahme auf die Warteliste ist kostenlos und unverbindlich.
(1) Für das eigentliche Mietverhältnis gelten ausschließlich die Bedingungen des individuell geschlossenen Untermietvertrags (KW-Serie) sowie dessen Anlagen (Hausordnung, Dauerrechnung, Übergabeprotokoll).
(2) Wesentliche Eckdaten des Untermietvertrags:
(1) Die Nutzung der Website ist kostenlos. Königstadt behält sich vor, den Betrieb der Website jederzeit einzustellen oder Inhalte zu ändern.
(2) Der Nutzer verpflichtet sich, keine falschen oder irreführenden Angaben im Kontaktformular zu machen.
(3) Das Scraping, automatisierte Abfragen oder sonstige maschinelle Nutzung der Website ohne schriftliche Genehmigung sind untersagt.
(1) Königstadt haftet für Schäden aus der Nutzung dieser Website nur bei Vorsatz und grober Fahrlässigkeit. Für leichte Fahrlässigkeit haftet Königstadt nur bei Verletzung einer wesentlichen Vertragspflicht (Kardinalpflicht), begrenzt auf den vorhersehbaren, vertragstypischen Schaden.
(2) Für die Verfügbarkeit und die inhaltliche Richtigkeit der Website wird keine Garantie übernommen. Verlinkungen auf externe Websites liegen außerhalb des Einflussbereichs von Königstadt.
(3) Diese Haftungsbeschränkung gilt nicht für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie für Ansprüche nach dem Produkthaftungsgesetz.
(1) Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts (CISG).
(2) Ausschließlicher Gerichtsstand für alle Streitigkeiten aus oder im Zusammenhang mit diesen AGB ist Berlin, sofern der Anfragende Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen ist.
Sollten einzelne Bestimmungen dieser AGB unwirksam oder undurchführbar sein oder werden, bleiben die übrigen Bestimmungen davon unberührt. Die Parteien verpflichten sich, anstelle der unwirksamen Bestimmung eine wirksame zu vereinbaren, die dem wirtschaftlichen Zweck der unwirksamen Bestimmung am nächsten kommt.
Königstadt behält sich vor, diese AGB jederzeit zu ändern. Die jeweils aktuelle Fassung ist auf dieser Website abrufbar. Für bereits geschlossene Untermietverträge gelten die dort vereinbarten Bedingungen.

These General Terms and Conditions govern the use of the website koenigstadt-workspace.de as well as the inquiry and waitlist process. Individual rental terms are set out in the respective sublease agreement (KW series).
(1) These Terms apply to the use of the website and the contact and waitlist form of Königstadt Workspace GmbH (hereinafter "Königstadt" or "we").
(2) Königstadt offers office space and workstations exclusively to entrepreneurs within the meaning of § 14 BGB (German Civil Code). Rentals to consumers within the meaning of § 13 BGB are not available.
(3) Conflicting or deviating terms of the applicant shall not apply.
(1) Königstadt operates a coworking space with private offices and individual workstations at Straßburger Str. 55, 10405 Berlin. The offer comprises the subletting of workstations including shared infrastructure (kitchen, conference rooms, phone booths, internet, coffee) under the terms set out in the respective sublease agreement.
(2) The website serves informational purposes and captures rental interest. A contract is concluded exclusively by a sublease agreement signed by both parties.
(3) Availability and content displayed on the website are non-binding and do not constitute a binding offer.
(1) By submitting the contact form, you request to be placed on the waitlist. Being placed on the waitlist does not constitute a right to conclude a rental agreement.
(2) When a suitable space becomes available, Königstadt will reach out based on the waitlist. The selection is at Königstadt's sole discretion; in particular, fit with the existing community and economic criteria may be considered.
(3) Being placed on the waitlist is free of charge and non-binding.
(1) The actual tenancy is governed exclusively by the terms of the individually concluded sublease agreement (KW series) and its annexes (house rules, standing invoice, handover protocol).
(2) Key terms of the sublease agreement:
(1) Use of the website is free of charge. Königstadt reserves the right to discontinue the website or modify its content at any time.
(2) The user undertakes not to provide false or misleading information in the contact form.
(3) Scraping, automated queries, or other machine-based use of the website without written permission is prohibited.
(1) Königstadt is liable for damages arising from the use of this website only in cases of intent and gross negligence. For slight negligence, Königstadt is only liable in the event of a breach of a material contractual obligation (cardinal obligation), limited to the foreseeable, typical contractual damage.
(2) No guarantee is given for the availability or accuracy of the website's content. Links to external websites are outside Königstadt's sphere of influence.
(3) This limitation of liability does not apply to damages resulting from injury to life, body, or health, or to claims under the Product Liability Act.
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, provided the applicant is a merchant, a legal entity under public law, or a special fund under public law.
Should individual provisions of these Terms be or become invalid or unenforceable, the remaining provisions shall remain unaffected. The parties undertake to agree on a valid provision that comes closest to the economic purpose of the invalid provision.
Königstadt reserves the right to amend these Terms at any time. The current version is always available on this website. For sublease agreements already concluded, the terms agreed therein shall apply.
